Time limit for employment claim?


It is crucial that you stick to the time limits. For most cases, applications must be made within three calendar months of the alleged breach of the law. For unfair dismissal cases, this is 3 months from the ‘effective date of termination’ (usually the day on which you finish work) but there are some variations (for example, 6 months to claim redundancy payment).

It is very hard to persuade a tribunal to accept a claim which is ‘out of time’, even if only by a day. It is worth using registered post so that you can prove when you posted the application, in case it arrives late because of postal difficulties beyond your control. Where applications have been made on-line, there has been a recent ruling that the date that the Employment Tribunal acknowledged receipt of the form was the date on which the form was received.
